1. Acceptance of Terms

By accessing or using the DeskTrust platform and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including employers (account holders) and employees (monitored users). If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

DeskTrust is an employee monitoring and productivity tracking platform that provides screen monitoring, time tracking, application usage analytics, productivity scoring, and related services. The Service includes a web-based dashboard for employers and a desktop agent application installed on employee devices. Features and functionality may vary based on your subscription plan.

3. Account Responsibilities

As an account holder, you are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete registration information
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction
  • Obtaining proper consent from employees before monitoring, as required by applicable law

4. Subscription & Billing

4.1 Plans & Pricing

The Service is offered through various subscription plans (Starter, Growth, Enterprise) with different features and pricing. Current pricing is available on our Pricing page. Prices are subject to change with 30 days' prior notice.

4.2 Free Trial

New accounts may be eligible for a free trial period. At the end of the trial, you must subscribe to a paid plan to continue using the Service. No credit card is required for the trial.

4.3 Billing

Subscriptions are billed monthly or annually, depending on the plan selected. All fees are non-refundable except as required by law or as expressly stated in these Terms. Payments are processed securely through Stripe.

4.4 Cancellation

You may cancel your subscription at any time from your dashboard. Upon cancellation, your account will remain active until the end of your current billing period. After that, your account will be downgraded and monitoring data will be deleted according to your plan's retention policy.

4.5 Refunds

We offer a 14-day money-back guarantee for first-time subscribers. If you are not satisfied with the Service within the first 14 days of your paid subscription, contact us for a full refund. Refunds after 14 days are at our discretion.

5. Acceptable Use

You agree to use the Service only for lawful purposes. Specifically:

  • You will use the Service only for legitimate employee monitoring in a workplace context
  • You will obtain proper consent from all monitored employees as required by applicable laws in your jurisdiction
  • You will inform employees about what is being monitored and how data is used
  • You will not use the Service to monitor individuals without their knowledge where such monitoring is illegal
  • You will not use the Service for personal surveillance, stalking, harassment, or any illegal purpose
  • You will not attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • You will not attempt to gain unauthorized access to other users' accounts or data

6. Data Ownership

You retain ownership of all data collected through the Service, including screenshots, activity logs, and productivity reports ("Customer Data"). We do not claim ownership of your Customer Data. We process Customer Data solely to provide the Service to you. You grant us a limited license to store, process, and display Customer Data as necessary to operate the Service. Upon account termination, Customer Data will be deleted in accordance with our data retention policies.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESKTRUST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

8. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in activities that are harmful to the Service or other users. Upon termination: (a) your right to use the Service will immediately cease; (b) we may delete your account and Customer Data after a 30-day grace period; (c) any outstanding fees will remain due. You may terminate your account at any time by contacting us or through your dashboard settings.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Collin County, Texas. You agree to submit to the personal jurisdiction of such courts.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.

11. Employee Monitoring Disclosure

DeskTrust is designed for use by employers to monitor company-owned or company-assigned devices. By using DeskTrust, the subscribing organization agrees to:

  • Inform all monitored employees that DeskTrust is installed
  • Use collected data only for legitimate business purposes
  • Not use DeskTrust to monitor personal devices without explicit consent
  • Comply with all applicable employment and privacy laws
  • Provide employees reasonable access to their own monitoring data

DeskTrust is not designed for covert surveillance. The desktop agent is visible in the system tray and employees can see their monitoring status at all times.

12. Data Processing

DeskTrust processes employee data on behalf of the subscribing organization (the data controller). We act as a data processor and: process data only as instructed by the organization, implement appropriate security measures, do not sell or share employee data with third parties, support the organization in fulfilling data subject access requests, and delete all data upon contract termination. A Data Processing Agreement is available for organizations that require one.
